Terms of Service

These Terms of Service ("Terms") govern your use of the Sugar AI mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not a medical device

Sugar AI is a wellness and tracking tool. It is not a medical device. The glucose-rise estimates, food identification, and any related insights provided by Sugar AI are estimates for informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease, and they should never be used as a substitute for fingerstick readings, continuous glucose monitor (CGM) readings, professional medical advice, or insulin dosing decisions.

Always follow the guidance of your healthcare provider for diabetes management and medication.

2. Eligibility

You must be at least 13 years old to create a Sugar AI account. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You may not share your account or use someone else's account without permission.
• You may delete your account at any time from Settings → Account → Delete Account.

4. Subscriptions, free trial, and billing

• Sugar AI offers a free tier with a limited number of scans, plus paid Premium subscriptions billed monthly or annually.
• Eligible new users may start a 7-day free trial of Premium. If you do not cancel before the trial ends, your subscription will automatically renew at the price shown in the app, charged to your Apple ID.
• Subscriptions auto-renew until you cancel. To cancel, open the iPhone Settings app → tap your name → Subscriptions → Sugar AI → Cancel Subscription. You will retain Premium access until the end of the current billing period.
• Refunds are handled by Apple. Please contact Apple Support for refund requests.
• Prices may change. We will notify you in advance of any price increase that affects your subscription.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract the source code of the app.
• Interfere with or disrupt the Service, our servers, or other users' accounts.
• Submit content that is unlawful, infringing, harmful, or that you do not have the right to submit.
• Use the Service to make medical decisions for any person other than yourself.

6. Your content

You retain ownership of the meal photos, notes, and other content you submit to Sugar AI ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to host, store, process, and display Your Content solely to operate and improve the Service for you. We do not use Your Content to train external AI models beyond what is required for the food-identification feature to function.

7. Third-party services

The Service integrates with third-party services including Google Gemini, Apple HealthKit, LibreLinkUp, RevenueCat, and Supabase. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or behaviour of third-party services.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the estimates or food-identification results will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, Sugar AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Our total cumulative liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) USD 50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

10. Indemnity

You agree to indemnify and hold Sugar AI harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or if we are required to do so by law. You may stop using the Service at any time by deleting your account.

12. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of these Terms, except where applicable consumer- protection laws give you the right to bring proceedings in the courts of your country of residence.
